Blind Cerebral Palsy Victim Sues City Over Medical Marijuana

Wednesday, June 30th, 2010

Malinda Traudt may be blind and wheelchair-bound but she and her mother are fighters. So, when the City of Dana Point threatened to shut down the collective where they get the medical marijuana Malinda needs to stay alive and manage her pain, they filed suit.

Malinda was born with cerebral palsy, epilepsy, total blindness, and severe cognitive delays. Now 29 years old, she has been in a wheelchair her entire life. Recently, she was diagnosed with severe osteoporosis, a degenerative bone disease. Malindas doctor gave her pain medication but, within hours, her kidneys began shutting down, her lungs filled with fluid causing pneumonia, she developed a high fever, and vomited for 3 straight days. Malindas physician recommended that her mother contact hospice to arrange for Malindas final hours.

In a last-ditch effort to keep Malinda alive while managing her pain, Malindas mother and her pain specialist replaced the pain medication with medical marijuana. Almost immediately, Malindas fever subsided, she stopped vomiting, and her suffering lessened. Malindas kidneys regained function, she was able to eat, and she began smiling again. Her pain became manageable and her quality of life improved dramatically.

Malinda is a medical marijuana patient and member of the Beach Cities Collective in Dana Point. Malindas mother pushes her, in her wheelchair, to the collective to obtain her life-saving medicine. Unfortunately, Dana Point is trying to close Beach Cities Collective, along with all collectives in that City.

Although numerous lawsuits have been filed by dispensaries, Malindas is the first by a patient alleging the ban unconstitutionally interferes with her fundamental rights to life and safety, under the California Constitution.

According to Malindas attorney, Jeff Schwartz, When a dispensary challenges a ban, the city simply has to show that the ban serves a legitimate purpose, such as reducing crime, loitering, or traffic. Cities always win that battle. However, when a city interferes with a persons fundamental, constitutional rights, it must prove that the ban serves a compelling public interest and is narrowly-tailored to avoid interfering with other civil rights. And, the city almost always loses.

For more information, a copy of the lawsuit, or to schedule an interview, contact Jeff Schwartz at 888-7300-LAW or jeff@Schwartz4Law.com.

Saturday, May 22nd, 2010

Transcript of this video:
**Visit http://convivirconespasticidad.blogspot.com**

Hi my name is Claudia I am 22 and I have CP. I would like to think that I have a lot friends, through college. I am very ambitious in my work and I have a very active social life. Thats why I am making this video I have a CP but my CP doesnt define me entirely. CP just makes my life more interesting. My CP doesnt hold me back, it makes me a stronger person. This is the first time I have spoken via a video message for Convives con espasticidad The word disability is composed by the word ability and we have the obligation to remember this. Everyday. And we have the oblication to make sure that we educate ourselves, and the rest of society about this fact. We can write our own story. Like everyone else we only need the proper tools and the right information. This is the foundational belief and reason for the creation of the Convives con espasticidad association. Spasticity is a disorder of the central nervous system that increases muscle tone that prevents total or partial movement of the individual and others movements called involuntary spasms. These are characteristics that are shared and present among others disabilities: multiple sclerosis, cerebral palsy, spina bifida, spinal chord injury, dystonia, Amyotrophic Lateral Sclerosis (ALS). Millions of people need information. Information is POWER. The right information at the right moment can change your life, or any life, for that matter. We have a main goal to make it easier to access information for people with disabilities and their caregivers, supporters and other professionals in the medical field. We are establishing a project: Convivir con espasticidad. We are currently building our Web site.
We hope the Web site will provide three things:
•Information as a point of reference about all disabilities.
•A place for people with disabilities, families, caregivers and professionals to meet and share ideas, offer empathy and exchange experiences with one another.
•An informational tool, conscious of the feelings of society.
You will be able to find :
•Information about the disability
•Information about all the existing treatments.
•Medical advice.
•On-line medical advice .
•Resource for all things related to accessibility and standards for accessiblity.
•Other resources and links of interest (we wish to be a hub within the disability community and a relay station for helping you find the information you need).
•Local resources and advocacy that will help change the realities within your community
•Chats, Forums and a Blog.
•An Idea Box where you can give us feedback and suggestions on how to improve the site.
•Information on activities organized by CONVIVES
•And finally, a way to Contact Us.

Specific Contents includes:
A place FOR CHILDREN:
•Games and competitions according to age.
•Travel tips
FOR ADOLESCENTS AND ADULTS:
•Contests
•Information about eLearning and telecommuting.
•Employment opportunities
•Local meetings, weekend activities etcetera
FOR PARENTS :
•Support groups
•Respite activities and programs for parents to revitalization and rejuvination
FOR Medical Professionals and other SPECIALISTS:
•An area to publish opinion articles.
•Access to a professional members area.

We provide you with the open door it is up to you to walk through it. Our Mission: Convivir con la espasticidad is not owned by anyone, it is owned by all of us. Our dream is to achieve equality for everyone. We hope that we will realize our own futures with arms and eyes open. Anything is possible.

Do you want to be a part of this movement? I welcome you to join us as we explore the world and its possibilities for all people with disabilities.

Sara Pyszka, Wright State University student

Wednesday, April 28th, 2010

Sara Pyszka is a senior at Wright State University. Because she has cerebral palsy, she is not able to speak. However, she is able to communicate with a computerized device.
Dayton Children’s and Wright State University held an event called “Stop the Silence” to raise awareness about communication disorders. Imagine how devastating it would be if you lost the ability to talk due to a stroke or accident and what affect that would have on your life. Some children who receive speech therapy services at Dayton Children’s are unable to use their voice to communicate due to congenital problems such as cerebral palsy. Learning to use a computerized device is a very long and complicated process and requires the assistance of a trained speech/language pathologist. Often times, these services are not covered by health insurance.
If you are interested in making a donation to support Dayton Children’s speech therapy department, call 937-641-3405 or log on to www.childrensdayton.org/donate. Through your generous donation, we can “stop the silence” and give children a voice.
