If an ex-wife receives a settlement from a med mal case, does that money count as income for child support?

Ex wife is receiving a settlement from a medical malpractice lawsuit. Can we take her back to court and have this money included in the child support calcuation as part of her income?
Ex-wife who is on social security claims that she is unable to work is receiving a medical malpractice settlement. When child support was calculated, they used her social security as her income. When she receives the settlement…will social security be stopped and if so, will they use the settlement as a source of income?

8 month pregnant mother went to regular check up. up til now everything was going smooth. Told doctors she has had headaches for a week. they gave her a regular urine test(which showed high levels), to find out why they then asked her to do a 24 hour urine test. she dropped it off next morning at 9am friday. tuesday night we went to the emergancy room because she was still not feeling good. at the pregnancy ward the nurses came in with a dr. checked with the ultrasound, baby was not alive. meanwhile they checked the computer and found that they had her lab results from the urine test and that she had preeclampsia. the first thing we asked the dr was why didnt we receive a call asap after the urine test was dropped off. if we had found out on friday we could have gone to the hospital and had the baby delivered early. but because they did not call us and we had to go to the emergancy room ourselves it was too late. nothing can replace this loss in our lives, we have a lawyer and they are keeping us in the dark about everything because it is going to take years to recover any kind of settlement. does anyone have a figure on how much we are looking at for such a medical malpractice case. i am not trying to be greedy i just would like to know what would happen in this sort of matter because i see malpractice cases awarding up to 5 million dollars i think we deserve every penny from what we went through.

Preeclampsia can come on very suddenly, and it can progress very suddenly. You might very well not win, because you have to prove that the doctors actually knew something was wrong, and they had to know about it in time to actually do something about it. That is, even if you were notified the instant that they knew the problem, you might still have the same outcome.

I’m sure your liar negotiated this structured settlement with the insurance carrier. Your fees with it were set when you signed on, so look to the contract you signed with it. In general, it would be 1/3 of the current cash value of the settlement, unless it went to court in which you may be looking at 40%.

On a side note, structured settlements are normally used when a person has ongoing needs. If this is the case, don’t sell this thing to get your money now. You will get ripped off bad. It isn’t the lottery, and the amount of money you will end up with would be partied away in months. And you would end up having to pay for the future problems.

Then, when you are asleep, the surgical team will make an incision just above the navel.
A tube-shaped collar called a trocar will be placed inside the incision to hold it open.
Harmless carbon dioxide gas will be used to inflate the abdomen, serving to enlarge the work area and to separate the organs. Medical Malpractice
The team then inserts the laparoscope.
Once in place, the laparoscope will provide video images that allow the surgeon to see the inside of your abdomen.
Next, the team makes four more incisions – taking special care to keep the openings as small as possible. These openings will provide access for other surgical instruments.
Once the team has a clear view of the stomach, your doctor will insert a special tube into your mouth and throat. The surgical team guides the tube into your abdomen until the tip reaches the top of the stomach. Medical Malpractice

The valve will be sutured into place just below the skin in the upper left area of the abdomen. This valve will allow your doctor to adjust the tightness of the band and control the size of the opening into your stomach.

Running up against lawyer barriers in a Medical Negligence/Malpractice issue.?

My mother passed away last month due to gross medical negligence/malpractice. She went to a county run health clinic. I am being told by attorneys that they wouldn’t make enough money on the suit for it to be worth their while due to federal regulations on settlement amounts. I have googled, but apparently, I have not put in the correct search terms. Could someone please tell me what these are, and if it would be possible for me to persue action myself?

You have been contacting lawyers that work under contingency where you don’t pay them they take a % of the settlement.If they don’t think there will be a settlement they will not take the case. The only way you could do this is to hire a lawyer that you pay by the hour which is very expensive.

Where would I find a medical malpractice/negligence lawyer in Austin?

I am looking for a go get ‘em kind of medical malpractice/negligence lawyer in Austin. My mother passed on June 5th due to medical malpractice/negligence at the age of 62. I have tried the lawyer referral service, but it doesn’t take into account the attorney’s workloads or their want to take on a tougher case. I have tried looking it up online, but again, I spend a lot of time on the phone with people that don’t want to spend the time necessary for the case, but would rather take a quick 1 week settlement. Any suggestions?

You might have to dig into your pocket on this one. This is not the easy money kind that they like.
